Agreement on Terms of Use

General

These terms of use shall be applied to services (hereinafter referred to as ‘Service’) supplied by Hurtta & Co and Best Friend Group Oy (hereinafter referred to as ‘the Supplier’). In addition to these terms of use, other instructions and rules issued by the Supplier shall be binding on the user.

Parties

This agreement has been concluded between the Supplier and a user who has registered for the Service or the guardian of a minor person who has registered for the Service.

Minor User

Minor persons may only register for the Service with the specific consent of their guardian. Registered users who are under 15 years of age shall need their guardian’s specific permission to use chargeable services.

Privacy Protection

The Supplier shall comply with Finnish law when handling personal information. Classified information can only be disclosed to third parties when required by law. When disclosing information to the Service, the user agrees that the information in question may also be visible to other users, except for information that has been specified as classified.

The user may delete all his or her information when desiring to do so. Even then, log data required by law will remain in the Service at least for the time defined by law. (See the person file description.)

User’s Responsibilities

When using the Service, the user must comply with Finnish law, public decency and other general regulations concerning network services.

The user must not save, send or transmit to the Service material that is in violation of either the law or public decency, erroneous, harmful, indecent, pornographic, offensive, violent, aggressive, of an intrusive nature, or otherwise unpleasant.  All kind of material relating to intoxicants is absolutely prohibited. All kind of material that relates to racism and Nazism or violates human dignity, and racist behaviour are absolutely prohibited.

When registering for the Service and using the Service, the user must declare his or her own information in a truthful manner. Most information may be specified as classified.

The user must make sure that the hardware or software used do not cause harm to the Service or to the other users of the Service. Deliberate overloading of the Service is also prohibited.
The user must not use the Service for measures that are in violation of the law or public decency. Nor must the user, without specific permission, copy, distribute, send or transmit material that exists in the Service and has been produced by the Supplier or third parties. Nor must the user, without specific permission, advertise in the Service any products, services or Web sites, unless the user has a written marketing contract with the Supplier.

The user is responsible for reporting to the Supplier any violations of the contractual terms committed by other users.

Liability

The user shall be liable for direct or indirect damage he or she has caused to the Supplier or to a third party. If a third party demands damages from the Supplier as a consequence of the user’s actions, the user shall be liable to compensate the Supplier for the damage caused.

The user shall be personally responsible for backup copying of any material saved in the Service. If information is deleted or lost from the Service, the Supplier shall not liable for it.

User ID

User ID and password are personal. The Supplier will never ask for your password, and they must not be surrendered or given to anybody else. The user shall be responsible for actions taken by using his or her user ID.

The Supplier’s Rights and Responsibilities

The Supplier reserves the right to terminate this agreement without prior notification. When the agreement expires, the Supplier reserves the right to delete from the Service all material saved by the user and the information relating to the user.

The user assigns to the Supplier every right to edit, delete and distribute and commercially utilise material saved by the user in the Service.

This agreement can be transferred to a third party without prior notification.

The Supplier will not monitor, examine, edit or surrender the user’s private messages to third parties, except in the following situations:

   1. as required by the law or some other stipulation
   2. if it is necessary to prevent violation of the terms of use
   3. if it is necessary to protect the rights of the Supplier or a third party.

The Supplier shall have the right to prohibit the user from using the Service. Circumventing the prohibition in various methods is prohibited.

Guarantee and Limitation of Risk

The Supplier does not guarantee the faultlessness, constant usability or speed of the Service, the accuracy and reliability of the information, or reparation of errors contained in the Service.

The Supplier shall not be liable for tangible or intangible damage incurred by the user for using the Service.
The Supplier’s liability for damage shall in all cases be limited to the sum of money that the user has paid for the Service.
The Supplier shall not be liable for the content of links or advertisements contained in the Service.

Modifications

The Supplier reserves the right to make modifications to the Service or to these terms. Modifications to the Service or these terms of use that are essential to the user will be reported in advance, if it is feasible.

Chargeable Services

The prices and terms of subscription and delivery of chargeable services are explained in connection with a subscription of a chargeable service.

If the user personally deletes his or her user ID or if the administrator deletes a user ID on the basis of any violation, the user shall lose any chargeable services subscribed for his or her user ID, and the user will not be reimbursed for them.

The user shall not have the right of revocation for chargeable services after the performance or delivery of such a chargeable service has been electronically started with the user’s consent.

Links and Advertisements

The Supplier shall not be liable for the content of links or advertisements contained in the Service.
Advertising in the Service without specific permission is absolutely prohibited!

Disagreements

The terms of use shall be governed by Finnish law. Any disagreements shall be heard at Kuopio District Court.
